"New Regulations Signal Major Changes in 401(k) Plans Speakers: Richard W. Flynn, CEBS President Flynn 401(k) Solutions
New rules requiring the disclosure of internal fees and charges against account retirement plan assets may drive major changes in how 401(k) plans are funded. The new rules, first proposed by the DOL in September of 2008, are the result of years of congressional hearings aon the operations of qualified retirement plans and the investment products used to fund their benefits. Of particular concern to the regulators is the transparency of such investments to plan participants who must choose from an array of investment choices.
The new regulations will present a detailed array of new information to be used:
1. By the Plan Sponsors in their role as plan fiduciaries to select and monitor plan investment choices, and
2. By Plan Participants to choose from the investment choices available and evaluate the internal costs of such investment choices as they accumulate dollars for retirement.
The required disclosures deal with information that is unfamiliar to most human resource and benefit professionals--the fees, charges and levies made internally as part of the asset investment process for the funding of ERISA governed retirement plans.
This discussion will center on how these rules work, who is responsible for disclosure, the role of deregulation, and the impact the new disclosures should have on human resource management, plan sponsors as fiduciaries, participants and funding.
